KAS dismisses Kreshnik Hajdari/ DP: The decision creates a dangerous precedent

The Democratic Party has described the decision of the Complaints and Sanctions Commission (KAS) to leave Kreshnik Hajdari in office as mayor of Kuçova as a dangerous precedent for the elections.

In a statement to the media, the Secretary for Legal and Electoral Affairs in the blue headquarters, Marash Logu, stated that the decision is an open attempt to undermine the Decriminalization Law, which was adopted as a vital guarantee to cleanse local government of persons with criminal pasts.

He added that the citizens of Kuçova and Albania deserve to be represented by officials who respect the law, not by individuals who violate it and who remain in office with unilateral decisions.

We recall that a few days ago, the KAS upheld the CEC decision on the mandate of the Mayor of Kuçova, Kreshnik Hajdari. Hajdari was sentenced by a final decision in July 2024 to 6 months in prison for falsifying the decriminalization form, converted into probation. The mayor had not declared a sentence received on June 23, 1999 by a final decision from the Court of Ioannina for entering Greek territory without permission, converted into a remedial measure of "reprimand" due to his age of 17. The decision of the Complaints and Sanctions Commission (KAS) to leave the mandate of the mayor of Kuçova, Kreshnik Hajdari, in force, constitutes a serious blow to the rule of law and a direct violation of citizens' trust in institutions and free voting.

The Democratic Party considers this decision as an open attempt to annihilate the spirit and letter of the Law on Decriminalization (Law No. 138/2015). This law was adopted as a vital guarantee to cleanse the administration and local government of persons with criminal records and to protect the integrity of public offices.

After the Special Court (SPAK) found the Socialist Party official guilty and sentenced him for falsifying the decriminalization form, his continued tenure through legal acrobatics is indefensible. This decision sets a dangerous precedent, where concealing criminal records and defrauding state and electoral institutions are not only not punished by dismissal, but are publicly tolerated.

The Electoral Code and the Constitution of the Republic of Albania cannot be interpreted with double standards to protect the political interests of the government. The citizens of Kuçova and all of Albania deserve to be represented by officials who respect the law, not by individuals who violate it and who remain in office thanks to unilateral decisions.

The Democratic Party declares that this battle for the legality and dignity of the vote will continue at all remaining levels of the judiciary. We remain steadfast in defending the standards of free and fair elections from any element that distorts the will of the sovereign.
