A federal judge has overturned the US administration's suspension of visa processing for migrants from 75 countries, including Kosovo.

According to the Southern District Court of New York, the US administration's decision is considered "unlawful" and Judge Jeannette Vargas said that US Secretary of State Marco Rubio "exceeded his authority" when he made the decision.

The decision, which came into effect in January of this year, suspended the processing of migrant visa applications from citizens of 75 countries, including Kosovo, Albania, North Macedonia, Montenegro and Bosnia and Herzegovina.

Also included in this ban were countries such as Afghanistan, Egypt, Brazil, Iraq, Nigeria, Somalia, Thailand and Yemen.

“The State Department will suspend the processing of immigrant visas for 75 countries whose immigrants receive unacceptable levels of U.S. public assistance. This suspension will remain in effect until the United States is satisfied that new immigrants will not take advantage of the American people,” the State Department wrote in a January X letter announcing the decision. But Vargas ruled that consular officials were wrongly instructed to deny immigrant visas based solely on an applicant’s country of origin.

The US administration may appeal the federal court's decision.

Before the decision was published, on January 4, US President Donald Trump published on Truth Social a list of countries whose migrants receive social assistance from the US Government.

Kosovo was among them, as 46 percent of Kosovar immigrants living in the US receive social assistance from the government there, according to the list published by the American president.

 Trump promised during his presidential campaign for a second term in the White House to deport millions of undocumented migrants, and his administration has taken a series of actions since he returned to the White House, measures aimed at accelerating deportations and reducing the number of illegal border crossings./ REL
