What happened?
Speaking at the World Law Congress, which is taking place in Tirana, Prime Minister Rama spoke about an independent justice system in Albania. Rama said that without the 'blessing' of the European Union, today, Albania would not have an independent system, far from arbitrariness.
"It is not the person, or their nationality, the history of the people they come from, that determines the individual's behavior in relation to the law, it is the system. The creation of a system then makes arbitrariness impossible, which even today as we speak is everywhere in our state system, including the justice system. If Albanians did not love the EU so much, we would never succeed in establishing an independent justice system," said Rama.

This statement by Rama is presented in front of a completely different panorama. If we refer to the justice system, we cannot talk about independence, when we consider the case of Belinda Balluku.
Rama and the majority used the cardboard as a tool to reject the Special Prosecution's request for the arrest of the former deputy prime minister accused of violating equality in tenders. It was even Rama himself who brought the GJKKO decision to suspend Balluk from office and ban him from leaving the country to the doors of the Constitutional Court.
Rama's political interventions
The investigation into Belinda Balluku turned into an open battle between Rama and the 'independent' justice system, which the prime minister trumpets as an achievement of the Renaissance.
But it was the creator of the new justice system himself who brought the GJKKO decision to suspend Balluk to the Constitutional Court. In the government's request, it was argued that the decision in question was unconstitutional.
Rama himself openly attacked the Special Court after the latter imposed the measure of suspension from duty on Balluk. At that time, during the meeting of the SP group, Rama attacked the Special Court, rejecting the accusations against Balluk.
"The mere announcement of the accusation on the crooked path, and unfortunately made a habit by the "train station" investigative groups, who use the media as a paramilitary force to blame and annihilate their subjects, was enough to raise waves of hatred against Belinda Balluku and boil 700 pots," said Rama.
The prime minister even claimed that he had rejected Balluk's resignation three times. "There is no resignation under pressure from a power that has left its own territory and entered the territory of the independence of the executive branch," said Rama, openly attacking the judges of the Constitutional Court.
SPAK, immunity and the EP's warning

MCAllister dha një mesazh të qartë kur deklaroi se çështja ‘Balluku’ është një test kritik për Shqipërinë në luftën ndaj korrupsionit.
“Nuk jam në pozicion të komentoj raste individuale në detaje, por do të them se çështja që përfshin zv/kryeministren Balluku është test kritik për Shqipërinë në luftën e saj kundër korrupsionit. Kjo është gjithashtu një pyetje për përgjegjësinë politike dhe duhet të zgjidhet brenda qeverisë shqiptare”, deklaroi MCAllister.
Më 12 Mars, Kuvendi votoi kundër kërkesës së SPAK-ut për dhënien e autorizimit për arrestimin ose heqjen e lirisë për ish-zv.kryeministren Belinda Balluku, duke injoruar sinjalin e marrë nga zyrtari i Parlamentit Evropian.
Me 82 vota kundër të maxhorancës dhe 47 pro të deputetëve të opozitës u rrëzua kërkesa për ndryshimin e masave të mëparshme, dhënë nga Gjykata e Posaçme, ajo e pezullimit nga funksionet qeveritare dhe ndalimit të udhëtimit jashtë vendit.
Në raportin e lexuar nga deputeti Oerd Bylykbashi, demokratët kërkuan të mos pengohej drejtësia. Opozita deklaroi se ky votim përbënte provë se socialistët po pengojnë edhe procesin e integrimit.
Për çfarë po hetohet Belinda Balluku?
Balluku po hetohet nga SPAK për dyshime në shkelje të barazisë në tendera dhe procedura të prokurimeve publike gjatë ushtrimit të detyrës si ministre e Infrastrukturës dhe Energjisë.
SPAK e ka regjistruar si person nën hetim për shkelje të barazisë në tendera. Sipas SPAK, përpos Tunelit të Llogarasë, Balluku është nën hetim edhe për 7 procedura të tjera prokurimi:
Plotësimi, rakordimi dhe vazhdimi i punimeve Sheshi Shqiponja-Lumi i Tiranës, Loti 1 dhe QMT;
Ndërtimi i segmentit rrugor Sheshi Shqiponja-Bulevardi i Ri, Loti 2;
Ndërtim i segmentit rrugor Sheshi Shqiponja-Bulevardi i Ri- Shkozë, Urat mbi lumin Tirana”;
Ndërtimi i Unazës së Jashtme Tiranë, Loti 4”;
Ndërtim i Unazës së Jashtme Tiranë, Loti 5”;
Ndërtim i Unazës së Jashtme Tiranë, Loti 6”;
Ndërtim i Unazës së Jashtme Tiranë, Loti 7”.
Raporti i PE: Imuniteti, jo pengesë për hetimet
Dy ditë më parë, Parlamenti Evropian miratoi raportin për Shqipërinë, ku ngre shqetësime të qarta për gjendjen e sundimit të ligjit, luftën kundër korrupsionit dhe pavarësinë e gjyqësorit.
Në konkluzionet dhe rekomandimet e raportit, është përfshirë edhe çështja “Balluku”. Raporti i referohet imunitetit parlamentar si një ‘kornizë për të siguruar funksionimin e duhur të institucioneve parlamentare’.
Ai thekson se çdo vendim i lidhur me imunitetit duhet të jetë në përputhje me dispozitat ligjore, pa ndërhyrje politike, çka korrespondon me refuzimin që mazhoranca i bën heqjes së imunitetit të Belinda Ballukut, e akuzuar për shkelje të barazisë në tendera.
“Recalls that parliamentary immunity is part of the constitutional framework designed to ensure the proper functioning of democratic institutions; stresses that any decision in this regard must be taken strictly in accordance with constitutional provisions and established legal procedures, without political interference and without unnecessary delays,” the report states.
The document highlights the pressure and threats directed at the justice system, emphasizing that such acts undermine the independence of the judiciary.
"Recalls that the judiciary continues to face political pressures and threats that risk undermining judicial independence; underlines the importance of timely and full implementation of Constitutional Court decisions by the executive and legislative branches, as an essential element of the rule of law and institutional balance," the report continues./ Politiko.al
