Changes to the law on the Special Court, do they endanger Kosovo's relations with the West?

The European Union has twice reacted to amendments to the law on the Specialist Chambers by the Kosovo Assembly, saying that the legal changes conflict with Kosovo's international obligations. According to EU spokesperson Christian Wigand, the Specialist Chambers are delivering justice based on the principle of individual criminal responsibility.
"We call on Kosovo to adhere to its international obligations to ensure the judicial independence of the Kosovo Specialist Chambers, as well as its commitment to ensuring accountability and providing justice to victims and their families from all communities in Kosovo," Wigand said, adding at the same time "the protection and safety of witnesses must be ensured."
The independence of the Specialist Chambers must not be compromised.
There were also reactions from the German embassy in Pristina, which expressed concern about the changes that the Kosovo Assembly made on Tuesday night to the Law on the Kosovo Specialist Chambers, based in The Hague. The spokesperson for the German Embassy, Catalina Heine, told the media in Pristina that "The Kosovo Specialist Chambers are an independent judicial institution and that their independence should not be violated". "The Kosovo Specialist Chambers are an independent judicial institution and were established on the basis of Kosovo law and are based on the Constitution of Kosovo. Their goal is to ensure accountability and justice for victims from all communities in Kosovo. To fulfill this goal, their independence must be fully respected", the spokesperson Heine was quoted as saying, adding that the embassy also supports the EU's position against the changes to this law.
PDK: The law "does not violate" international obligations or the Constitution of Kosovo
Dhe do t'ia arrijmë”, thotë Gruda.
Another expert on the justice system, Ehat Miftaraj, from the Kosovo Law Institute (IKD), told DW that amending the law on the Specialist Court and its implementation is a complex process, because "without the involvement of international partners in the expertise, the law can hardly produce legal consequences in practice, or affect cases that are currently being processed in The Hague." "In this regard, consultations and cooperation with the main states of the Council of the European Union and the United States of America must urgently begin, so that these changes have effect and are applicable in practice, since any additions and amendments to the Law on Specialist Chambers are subject to legality assessment by the Specialist Chamber of the Constitutional Court in The Hague," says Miftaraj.
Miftaraj demands that Kosovo maintain relations with international partners. "The government and the new president should, in good faith and cooperation with international partners, discuss any additions or changes to the law, which has not happened."
The amended law is expected to be enacted.
The law amended by the Kosovo parliament for the Special Court, which is expected to be decreed by the newly elected president of Kosovo, Justina Pula-Shiroka, does not limit the Court's commitment to continue investigations into organ trafficking during the war in Kosovo, alleged by the report of the Parliamentary Assembly of the Council of Europe, for which the Special Court was established.
But the now amended law foresees the narrowing of the mandate of the Special Court in some areas, which includes the time period covered by the Court, from the period of the previous law, January 1998-December 2000, to July 1, 1999-December 31, 2000. The law also foresees the limitation of the maximum prison sentence to 15 years, the retention of sentences in Kosovo and the possibility of presidential pardon for persons convicted by a final decision.
Based on these key points of the law, political scientist Artan Muhaxhiri says that "issues related to jurisdiction, maximum limits of sentences provided by law and other similar issues must be argued in a professional and rigorous manner, proving that they fully guarantee the independence of the judiciary and that they are firmly based on the legal system of Kosovo, that is, on the same legal system that established the Specialist Chambers."/DW
