When state guards become local guards, what does the law say about police officers working as bodyguards?

The murder of 20-year-old Portuguese tourist Luis Miguel Varela Mendes in Ksamil is not only a tragedy for the family of the young man, who came to Albania for vacation and will return home in a coffin.

After this serious event, there is another worrying aspect, the presence of state employees in the environment where the crime occurred and the role they played before and after the event.

At least three employees of state structures appear to have been engaged as security personnel at the premises where the incident occurred. Two of them are police officers, while another is an employee of the prison system.

According to the Police, they did not intervene to prevent the incident and did not notify the authorities afterwards. For this reason, charges related to failure to report the crime and failure to take measures to end the illegal situation have been filed against them.

The case becomes even more disturbing when compared to another incident that occurred just a few days ago in Saranda, where State Police officers were again found to be engaged in a private bar and ended up suspended from duty.

The Ksamil Case 
At the "Principote" beach bar in Ksamil, where Portuguese tourist Luis Miguel Varela Mendes was killed, several people, including employees of state structures, acted as security personnel.

These are Miosid Matushaj, a State Police employee at the Border and Migration Directorate in Gjirokastra; Luçiano Seferi, an employee of the Fier prison; Romeo Shehu, an employee of the Gjirokastra Municipal Police; and Kristi Koshi.

According to the Police, these individuals were on security duty at the premises of the bar and did not intervene to prevent the incident. After the crime, they did not notify the Police of what had happened.

Matushaj, Seferi and Shehu have been arrested, and investigations are underway against them for criminal offenses related to "Failure to report a crime" and "Failure to take measures to end the state of lawlessness." For one of them, the investigation is also related to "Supporting the perpetrator of the crime."

So, in the place where a tourist lost his life, among the people who were supposed to guarantee security were people who were themselves part of state structures.

The Case of Saranda 
Just a few days ago, another event in Saranda highlighted a similar situation.

At around 03:20 on August 16, a conflict broke out between several people outside a bar in Saranda. The physical altercation involved the head of the Crimes Department of the Saranda Police Station, Mateo Bakalli.

Sipas Policisë, rojet e sigurisë së lokalit po konfliktoheshin fizikisht me disa persona. Bakalli, i cili po kalonte me automjet, ka ndërhyrë për të ndaluar konfliktin pasi është identifikuar si punonjës policie. Por rojet e sigurisë kanë nisur ta godasin me grushte.

Në total, gjashtë persona u arrestuan dhe një tjetër u shpall në kërkim. Mes tyre kishte edhe persona të angazhuar si roje sigurie, ndërsa një prej të arrestuarve ishte ushtarak.

Por sërish, në këtë ngjarje shfaqen punonjës të Policisë së Shtetit.

Drejtori i Përgjithshëm i Policisë, Skënder Hita, pezulloi nga detyra inspektorin Armando Shehi, efektiv të Repartit “RESI”, dhe nënkomisarin Andon Binaku, efektiv të RENEA-s.

Sipas Policisë, dy efektivët ishin të dypunësuar pa leje në lokal. Edhe pse ndodheshin jashtë detyre, ata nuk kishin njoftuar për konfliktin dhe duhej të ndërhynin për të parandaluar përshkallëzimin e situatës.

Dy ngjarje të ndryshme, por një element i përbashkët. Punonjës të strukturave të shtetit që gjenden të angazhuar në sigurinë e lokaleve private dhe që, në momentet kur situata del jashtë kontrollit, përballen me detyrimin për të vepruar si efektivë shtetërorë.

Çfarë thotë ligji për policët jashtë shërbimit?
Rasti ngre edhe një pikëpyetje ligjore mbi dypunësimin e efektivëve.

Ligji nr. 82/2024 “Për Policinë e Shtetit”, në nenin 9, pika 3, përcakton se çdo punonjës policie, “gjatë kryerjes së detyrës ose jashtë saj”, vepron për përmbushjen e nevojave dhe pritshmërive të publikut për garantimin e rendit dhe sigurisë publike dhe e përdor autoritetin që i jep ligji vetëm për këtë qëllim.

Po kështu, neni 10, pika 1, përcakton se punonjësi i policisë vepron për të parandaluar një veprim ose mosveprim të kundërligjshëm ose ndërhyn menjëherë për të ndërprerë pasojat e paligjshme që përbëjnë rrezik të drejtpërdrejtë për jetën, shëndetin, sigurinë ose pronën.

Ndërkohë, rregullat për veprimtaritë private të punonjësve të Policisë parashikojnë se angazhimet dytësore lejohen vetëm nëse nuk krijojnë konflikt interesi, nuk lidhen drejtpërdrejt me veprimtarinë policore dhe nuk ndikojnë në ushtrimin e detyrave apo në kohën e punës.

Në të njëjtën kohë, ligji nuk lë një boshllëk për sjelljen e policit jashtë orarit të shërbimit, pasi statusi i tij si punonjës policie dhe detyrimi për të reaguar ndaj një rreziku serioz për rendin dhe sigurinë publike nuk zhduken vetëm sepse ai ndodhet jashtë turnit.

Pikërisht këtë parim e bëri të qartë edhe Policia në rastin e Sarandës, kur deklaroi se dy efektivët, pavarësisht se ishin jashtë detyre, duhej të ndërhynin për të parandaluar përshkallëzimin e konfliktit.
