The acting president of Kosovo, Albulena Haxhiu, has addressed the Constitutional Court to request interpretation regarding the exercise of presidential powers after the end of her six-month mandate, in the event that the Assembly fails to elect a new president.

The request was submitted on October 5, one day before the end of the constitutional deadline for electing a president. The news was confirmed by the Office of the President in a response to Radio Free Europe.

According to the Office of the President, the request was made based on Article 113, paragraph 3, subparagraph 1 of the Constitution.

" It has been requested to determine how and by whom the necessary presidential powers are exercised after the end of the six-month period, in the event that the new president has not yet been elected ," the institution's response states.

The uncertainty over the announcement of the elections The
issue becomes particularly important if the Assembly fails to elect the president by October 6. In this case, according to constitutional provisions, the Assembly is dissolved and the country heads towards early parliamentary elections.

The Constitutional Court had determined in March that, if the president is not elected within the deadline, the Assembly is automatically dissolved, while early elections must be held within 45 days.

But one unclear point remains: who will call the elections if the country does not have an elected president?

The Constitution attributes to the president the power to call elections, while Article 90 stipulates that the acting president cannot hold this position for more than six months.

This is precisely one of the issues that Haxhiu has requested to be interpreted by the Constitutional Court.

"The Constitution grants this power to the president. Determining the authority that can exercise it in the circumstances is one of the main issues we have presented to the Court ," the Office of the President stated.

According to the institution, the goal is to find a solution in accordance with the Constitution, which would enable the announcement and holding of elections within the established deadlines.
